staXscale Privacy Policy

Effective: October 2025

This Privacy Policy explains how staXscale, LLC (“staXscale,” “we,” “our,” or “us”) collects, uses, and protects information when you use our website, hosting platform, and related services (“Services”). It also describes your rights and choices regarding your data. This policy is part of our Terms of Service.

1. Who we are

staXscale provides managed cloud hosting built on Google Cloud infrastructure. We maintain the hosting environment (uptime, monitoring, and security) while customers manage their own sites, plugins, and content. Because our infrastructure runs on Google Cloud, your data is also subject to Google Cloud’s Data Processing Addendum and security certifications.

2. Information we collect

We collect only the information necessary to operate our business, provide support, and maintain account security. This may include:

  • Account information: Name, email address, billing details, and payment history.
  • Payment data: Payment card or PayPal information handled securely through our third party payment processor (Stripe). We don’t store or have access to full card details.
  • Technical data: IP addresses, login history, and system logs generated during use of our platform.
  • Support data: Any information you voluntarily include in support tickets or emails.
  • Cookies and analytics: We use limited cookies for login sessions, performance monitoring, and website analytics.
  • Hosted content: We host websites and data that you control. We may access or review your hosted content when necessary to maintain system security, investigate suspected violations of our Acceptable Use Policy, or comply with legal obligations. In those limited cases, access is restricted to authorized personnel and handled in accordance with this Privacy Policy and our Security & Compliance Overview.

3. How we use your information

We use your data to:

  • Provide, maintain, and improve our Services
  • Process payments and manage billing
  • Respond to support requests and technical issues
  • Monitor system performance and security
  • Communicate updates, policy changes, or planned maintenance
  • Comply with legal obligations and enforce our Acceptable Use Policy and Service Level Agreement
  • We may also use your contact information to send occasional product updates, service announcements, or promotional offers related to staXscale. You can opt out of marketing communications at any time by clicking “unsubscribe” in our emails or by contacting [email protected].

4. Legal bases for processing (GDPR)

staXscale is a U.S.-based company primarily serving customers in the United States. However, we recognize that some of our customers and visitors may be located in other regions, including the European Economic Area (EEA). For those users, we process personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). For users located in the European Economic Area, we process data under the following lawful bases:

  • Contractual necessity: To deliver the hosting and support services you’ve requested.
  • Legitimate interests: To maintain system security, prevent fraud, and improve service reliability.
  • Legal obligation: To comply with applicable laws or lawful requests.
  • Consent: When you opt in to receive optional marketing or updates.

5. How we share information

We do not sell or rent ANY customer data. You’d be shocked how common that is in the hosting world. We share information only when necessary to operate our Services or comply with the law:

  • Infrastructure partners: Google Cloud hosts our servers and maintains SOC 2 Type II and ISO 27001 compliance.
  • Payment processors: Stripe and PayPal securely process payments on our behalf.
  • Operational tools: Trusted third-party vendors used for billing, support, and monitoring.
  • Law enforcement: We cooperate with authorities when legally required or when we believe content is illegal or harmful, as described in our AUP.

6. Data retention

We keep account and billing data as long as you maintain an active account and for a reasonable period afterward to comply with legal and accounting requirements. Support emails and system logs may be retained for troubleshooting and security auditing. You can request deletion of your account and associated data at any time (see Section 10).

7. Data security

Your data is protected through a layered security approach aligned with our Security & Compliance Overview. This includes HTTPS/TLS encryption, access controls, MFA for administrators, regular backups, and monitoring for anomalies. While no system is invulnerable, we actively maintain safeguards consistent with industry best practices.

8. International data transfers

Your information may be processed or stored in data centers operated by Google Cloud in the United States or other locations. Google Cloud adheres to recognized frameworks such as the EU–U.S. Data Privacy Framework and Standard Contractual Clauses for cross-border transfers.

9. Your rights

We believe privacy rights should be clear and accessible, not buried in legalese. While we have to meet formal requirements like GDPR and CCPA, our goal is simple – to help you understand and control your data. If you ever have a question or need help exercising a right, we’ll do our honest best to guide you through it quickly and transparently.

Depending on your location, you may have the right to:

  • Access a copy of your personal data
  • Request correction or deletion
  • Object to or restrict certain processing
  • Withdraw consent (for marketing communications)
  • Request a portable copy of your data

To exercise any of these rights, email [email protected]. We’ll respond within 30 days where legally required.

10. Data deletion requests

To close your account and delete your personal data, email [email protected] from your registered email address. We’ll confirm your identity and process the deletion unless retention is required by law (e.g., tax or fraud-prevention obligations).

11. Cookies & tracking

staXscale uses minimal cookies for authentication and analytics. You can manage or disable cookies in your browser settings. We don’t use invasive advertising trackers.

12. Children’s privacy

staXscale is not directed at children under 18. We do not knowingly collect information from minors. If you believe a child has provided data, please contact us to remove it promptly.

13. Policy updates

We may update this Privacy Policy from time to time. Substantial changes will be announced via email or via dashboard notice. Continued use of our Services after updates means you accept the new version.
